The New Jersey Department of Education has issued a memo <\/span><span style=\"font-weight: 400;\">[1]<\/span><span style=\"font-weight: 400;\"> which they declared in no uncertain terms that \u201crequiring the execution of a waiver or release of present or future claims as a condition to implement a student\u2019s IEP is prohibited.\u201d\u00a0<\/span><\/p>\n<p><b><\/b><b>Parents should be part of the process to determine compensatory services.<br \/>\n<\/b><span style=\"font-weight: 400;\">This memo also makes clear that \u201cthe need for compensatory services is an individual determination made by the student\u2019s IEP team, which includes the student\u2019s parent(s)\/guardian(s).\u201d We note this because some of our clients have been advising us that the Districts are telling them that the child study team, which does not include the parents, will be determining the need for compensatory services.<\/span><\/p>\n<p><b>TIP: <\/b><span style=\"font-weight: 400;\">Keep track of missed sessions, and sessions that are not effective.
